Justifiable Death Ruling

 The Birmingham Police Department reports detectives have received a ruling in connection to the homicide investigation of Jayvonne Banks. The incident occurred on Wednesday, January 11, 2023.

Investigators presented information gathered to the Jefferson County District Attorney’s Office for review. Following an assessment, the Jefferson County District Attorney’s Office rules the actions justifiable.

The Birmingham Police Department has 5 murders thus far in 2023 including 1 justifiable death investigation.

The Birmingham Police Department adheres to FBI Uniform Crime Reporting guidelines set for all law enforcement agencies across the United States. FBI Uniform Crime Reporting guidelines do not require law enforcement agencies to include justifiable death investigations in the total homicide investigations counts.

**The information is based on a preliminary and ongoing investigation, which continues to evolve as investigators interview witnesses, review physical and electronic records, and analyze forensic evidence. Homicide Investigation

(Media Release 10)

The Birmingham Police Department is conducting a homicide investigation. The incident occurred on Wednesday, January 11, 2023.

The victim has been identified as:

Jayvonne David Banks, (28), B/M, of Birmingham, Alabama.

At approximately 5:10 PM, South Precinct officers were inside the Adonna Apartments on a call for service when they heard shots being fired in the complex.

Officers were in the 1800 Block of Aspen Run when they located an adult male armed with a firearm. Officers also observed the victim lying unresponsive on the ground suffering from an apparent gunshot wound.

Officers were able to take the armed male into custody free of any incident. Birmingham Fire and Rescue personnel arrived on the scene and pronounced the victim deceased.

The preliminary investigation suggests several individuals were involved in an argument at the location. The person in our custody is a close relative to a party involved in the argument. The victim reportedly is in a close relationship with the same separate party involved in the original argument.

Officers observed a firearm near the victim.

The person in custody was transported to the Birmingham Police Headquarters where Homicide detectives interviewed him; he was then booked into the Birmingham City Jail under a 48-Hour Felony Extension.

This case information will be presented to the Jefferson County District Attorney’s Office who will decide if criminal charges should be filed.
