Justifiable Death Ruling

The Birmingham Police Department reports detectives have received a ruling in connection to the death investigation of:

Jamel Nathan Thomas (29), B/M, of Birmingham, Alabama.

The incident occurred on Tuesday, November 8, 2022.

Investigators presented the information gathered to the Jefferson County District Attorney’s office for review. Following the assessment, the Jefferson County District Attorney’s Office ruled the actions justifiable. This investigation is reclassified as a Justified Death Investigation.

The Birmingham Police Department has 118 murders thus far in 2022 including 8 justifiable death investigations.

The Birmingham Police Department adheres to FBI Uniform Crime Reporting guidelines set for all law enforcement agencies across the United States. FBI Uniform Crime Reporting guidelines do not require law enforcement agencies to include justifiable death investigations into the total homicide investigations counts.

Death Investigation 5300 Block Avenue O

The Birmingham Police Department is conducting a death investigation.

On Tuesday, November 8, 2022, at approximately 12:44 AM, West Precinct Officers received a call of a home invasion in the 5300 block of Avenue O. At approximately 12:46 AM officers received a call of an adult male shot at Chevron located at 1381 Bessemer Road.

The preliminary investigation suggests the adult male told people at Chevron that he had been shot and those people called 911. Birmingham Fire and Rescue responded to the scene and transported the adult male to UAB hospital with life-threatening injuries.

The homeowner in the 5300 block of Avenue O reported they believed they shot an intruder who broke into their home.

Hours later the adult male succumbed to his injuries while at the hospital. Due to the proximity of the home invasion and where the adult male sought refuge, we believe the shooting is connected.

The homeowner cooperated with investigators. Investigators will present their findings to the Jefferson County District Attorney’s Office.
