Homicide Investigation
The Birmingham Police Department is conducting a homicide investigation. The incident occurred on Saturday, December 16, 2023.
The victim will be identified upon notification to the next of kin.
At approximately 12:12 p.m., South Precinct officers were responding to a call of a person shot in the 1100 Block of 12th Street South.
Officers arrived on the scene and observed an adult male lying unresponsive, inside a restaurant, suffering from an apparent gunshot wound.
Birmingham Fire and Rescue Services arrived on the scene and transported the victim to UAB Hospital where he was pronounced deceased.
The preliminary investigation suggests, the victim, who was a customer at restaurant, was involved in a verbal dispute with the suspect, who is the owner of the business. The verbal dispute progressed into a physical altercation that led to the suspect firing shots and striking the victim.
The suspect has been detained.

FBI Uniform Crime Reporting guidelines do not require law enforcement agencies to include justifiable death investigations in the total homicide investigations counts.
