Arrest Made in the Homicide David Nicholas Investigation

The Birmingham Police Department reports detectives have obtained warrants for the arrest of three suspects in connection to the Homicide Investigation of David Nicholas.

David Nicholas was shot and killed on Saturday, December 23, 2023, in the 1400 Block of Lake Lane. An adult female was kidnapped during the incident then later located safe.

The suspects have been identified as:

  1. Dustin Stanfield, (43), of Hoover, Alabama.
  2. Joshua Guthrie, (33), of Birmingham, Alabama.
  3. Brittany Patterson, (33), of Mt. Olive, Alabama.

On Tuesday, December 26, 2023, Birmingham Police Detectives presented case information to the Jefferson County District Attorney’s Office. After an assessment of the information, detectives obtained warrants for Capital Murder (Kidnapping) and Kidnapping 1st Degree on the three suspects.

Stanfield and Guthrie were arrested on Sunday, December 24, 2023. Brittany Patterson was arrested on Saturday, December 30, 2023.

All three suspects will be held in the custody of the Jefferson County Jail with No Bond.

 Homicide Investigation

The Birmingham Police Department is conducting a homicide investigation. The incident occurred on Saturday, December 23, 2023.

The victim has been identified as:

David Nicholas, (43), W/M, of Birmingham, Alabama.  

Just before midnight, East Precinct officers were dispatched to a Person Shot call at a residence in the 1400 Block of Lake Lane Northeast.

Officers arrived on the scene and then observed the victim outside a residence suffering from injuries after being assaulted.

Birmingham Fire and Rescue personnel arrived on the scene and pronounced the victim deceased.

The preliminary investigation suggests a suspect(s) assaulted the victim at a residence in the 1400 Block of Lake Lane Northeast; the victim was able to flee the residence and seek help in the neighborhood. This incident was not random.

There is no one in custody.

The Jefferson County Medical Examiner’s Office will perform an autopsy on the victim to determine the cause of death.
